    Marriage Irretrievably Broken Down Is Due To Prolonged Separation and Failure to Maintain Marriage: Court at Mengo Affirms

    The Court at Mengo in Uganda recently ruled that prolonged separation and failure to maintain or communicate in a marriage constitute clear evidence of a union that has irretrievably broken down. This ruling came in the case between Ntongo Musiitwa Rebecca and Kinene Nicholas, who had been married for over five years but were living apart. The petition for the dissolution of the marriage was based on allegations of desertion and neglect, with the petitioner stating that the respondent had abandoned her and their children for over five years.

    Background of the Case

    Ntongo Musiitwa Rebecca, the petitioner, claimed that her husband, Kinene, had deserted her and their three children: Kinene Jordan Alpha (13), Kinene Jireh Able (9), and Kinene Jerusha Adonai (7). She alleged that for over five years, Kinene failed to meet his responsibilities, including financial support, school fees, and housing.

    In his defense, Kinene admitted to being away in Kenya for work, but he argued that he occasionally sent money back. However, he also expressed doubts about the paternity of two of the children.

    Court Issues for Determination

    The court was tasked with determining:

    1. Whether the marriage should be dissolved.
    2. Who should have custody of the children.

    Petitioner’s Arguments

    Representing himself, Kinene admitted to leaving but explained that his absence was for work purposes. He claimed he sent minimal amounts of money to his family, although only UGX 10,000 every three to four months. The court found this contribution grossly insufficient to support his family’s needs.

    Court Findings on Dissolution of Marriage

    The court emphasized that desertion involves the unjustified abandonment of marital duties, including providing for a spouse and children. The court referenced the Uganda Association of Women Lawyers (FIDA) case, which ensured that all divorce grounds apply equally to both spouses.

The petitioner had been solely responsible for the children’s welfare and education, while the respondent had refused to provide financial assistance and declined a DNA test to confirm paternity.

In the case of Florence Nyesigaomwe Ubriza v James Mugisha (Divorce Cause No. 41 of 2017), the court clarified the legal significance of dowry payments when they occur close to a church wedding. The court determined that this payment does not necessarily indicate the existence of a separate customary marriage.

    Background of the Case

    Florence Nyesigaomwe Ubriza (Petitioner) and James Mugisha (Respondent) married on December 21, 1991, at Kinyasano Cathedral Church of Uganda in Rukungiri District. After their wedding, the couple lived in Mombasa, Kenya, and later returned to Uganda in 1994. They then moved to London, England, in 2000 (Respondent) and 2001 (Petitioner). Their marriage produced one daughter, Theresa Ayebare Mugisha, who was 21 years old at the time of judgment.

    In 2019, the parties entered into a partial Consent Judgment, which dissolved the marriage and granted custody of their daughter to the Petitioner. The remaining issue was the division of matrimonial property, which included three disputed properties:

    • Kigezi Ruzhumbura Block 10 Plot 55 (9.5 acres at Kasheshe, Buyanzha)
    • Flat 9D1 Bugolobi, Block 111 Plot 33-41 Luthuli Rise
    • Residential house in Nabweru

The court stated that matrimonial property includes property to which both spouses contribute, whether monetarily or through other means. Justice Nagawa observed:

    Nabweru House:

    The house was acquired during the marriage, with the Petitioner making the primary financial contribution. The Respondent had an indirect role in supervising the purchase. The court ruled that this property was matrimonial, with the Petitioner entitled to a larger share due to her primary contribution.

    One of the worst ways to file for divorce is through letters or instant messaging. It would be better off for someone to be told in person with regards to their partner leaving them. Again, we all deserve an explanation when it comes to separation and being told other than in person is not something we would want to experience.

    Divorce has always been a topic no one wants to talk about, especially with regard to the people involved. You never want to be the person that tells someone that you want to go through a divorce, however, that still depends on the reason behind the divorce, to begin with. It may be something to do with domestic abuse, second parties, or emotional damage.

    There are people who would argue that leaving without a trace is the best thing to do when it comes to breakups, however, with divorce, it isn’t just a verbal commitment. A marriage is a legal agreement which means that assets and possibly children are involved in the relationship. Therefore the separation becomes more complex than it is.James had left his wife, Nicole, with many questions unanswered when he went away one week ago. Nicole had gotten surprised when he announced that evening that he had to leave all of a sudden, also adding that he would not be back for a while.

    What does that mean, ‘a while’?First Nicole tried to stop him, but James seemed determined and was gone within minutes.For a short amount of time, Nicole admitted to herself that it had to be for a good reason, but a few days passed and she got worried sick.Nicole tried many times to reach his phone, but without any luck. None of his friends could give her any clue either…

    It had been a week now and Nicole had no idea where her husband was.

    Not been a perfect relationship
    James’ period of absence had given Nicole some time to be able to think and reflect on their marriage. Admittedly, their relationship had recently been anything but perfect, but still, she had always felt like they could work through everything together if they would just try a little harder.

    It’d always gone well, hasn’t it?

    When it comes to relationships, especially with regard to marriages, it does not mean that the length of time can secure the partnership. Anyway, it does not connote either that if you are married you would last forever if only one side of the relationship is working on it. It is a partnered effort and not having enough communication can ruin things.

    Nicole and James were both on the introvert side of the spectrum and therefore not the types that fight a lot. The problem they’d been having was actually more of the lack of fighting or the lack of communication in general.

    For some reason, over the last few months, the couple had started to talk less and less to each other.Apparently, it is believed that if you can talk about it, and you can work things out, anything can be possible. However, the lack of communication will lead to disconnect, and no matter how much you try to avoid it, nothing good will result in it. If you can talk about it, then the less likely will it resolve into an argument or worse separation. .

    As far as Nicole knew, it was not her that was making no effort anymore. Mostly James was lacking. James was lacking the attention he clearly had so much for her before, while Nicole still felt as if she was trying her very best.

    But who knows? Maybe James felt this the other way around.

    Although even if we talk about the lack of James communicating well, it takes two to tango. Yet, the way he handled it wasn’t something we would assume is the right way to process this type of scenario. Whatever Nicole did in the long run though may have been something most of us would have done to adapt to a situation like such.

    Before James disappeared for a week, Nicole had gone with a group of her best friends on a two-week vacation a couple of months ago. It was very difficult to find two weeks straight in which all the girls were available, so Nicole had started planning this trip far ahead. And James had been quite supportive of her going on this trip. At the last minute, though, one of Nicole’s best friends had to cancel.

    Do you know that vacation where you just want to unwind and release the stress that have been boiled up over time? That is exactly the vacation that Nicole took. She needed the release and taking the said vacation was what she needed therefore there was no regret taking it. What happened next was the shocker.

    Before this trip, Nicole and James would always spend their vacant weeks together, especially when a trip to somewhere new was planned. Nicole had feared that by heading off with her friends like that, James would hate her for going. So, when her two weeks of vacation had come to an end, she thought that she may have been right in this assessment.

    James’ reaction when she returned from her vacation was worrisome. It had left Nicole wondering whether or not taking the trip to begin with was a decision she would regret afterwards.

    After Nicole returned from her trip, instantly she felt like the James she knew was gone and her husband was not the same anymore. He was so much more distant now, Nicole thought, and he would often just stay away at unknown places without her having any idea of where he went. And when she’d tried to talk with him about this, it was without success.There was a shift in the dynamics of the relationship and there was no turning back. It was as if the decision was made and everything else changed.

    Was two long weeks too long to be separated and for someone to change that quickly? It may have been the gap or distance apart, but there may be something more.

    Months went by and James’ changed behavior continued, building up to this point now where he was now away for a week already.

    He’d never been gone for this long and Nicole was seriously having doubts about whether she would ever see her husband returning. At least, until she got this letter in her hands now.

    Receiving a letter

    From the looks of the envelope, Nicole had initially had no idea that this letter was in any way related to James. It did not come from him directly, rather it was what appeared to be a message from the local government. When opening it, she expected that the paper was possibly related to outstanding bills or something in this regard.

    When she sat down in the living room to open it and read the first couple of sentences, she felt her whole world collapse in upon itself.

    Nicole was personally summoned to court to finalize her divorce from James!

    Her first reaction was that she might have misread it, but reading it a second and a third time made her realize that it was actually there.

    The first thing that popped in her mind was to read it word for word and understand what everything meant rather than jumping into conclusions the moment she received it. What shocked her is that the message of the letter was not something that would have become good news any time soon.

    The divorce was official

    Nicole could not believe it at first. She got another government letter from the drawer next to her and concluded that everything looked the same and as official as possible. There she sat for a while, eventually realizing that it was best to call James immediately. Of course, he again did not answer. Luckily the number of his lawyer was listed in the letter as well.Nicole dialed the number and got someone on the phone in an instant. Unfortunately, he was not able to give her much information about the reason for the divorce without the presence of James. What he did tell Nicole was that this had been in the works for a couple months already and was in no way a spur-of-the-moment decision.

    The man continued by explaining that Nicole’s best chance of getting some more answers to her questions was to come to the court hearing in a week’s time. Here, she would be able to ask James everything himself.She wanted to know now if it would be necessary for her to arrange a lawyer for this court date.According to James’ lawyer, it was always wise to arrange someone with legal experience. Yet in this case, it was not fully necessary. He did tell Nicole that his client, James, only wanted the divorce done and he was for the rest willing to meet most standard demands, even if they were in Nicole’s favor.

    Nicole was hurt

    The lawyer ended with this statement in the hope that it would calm down Nicole a bit, who was clearly in shock by all of it.On the contrary, his words actually only hurt her more, because in her eyes this meant that the only thing James wanted was not to be with her anymore and he was willing to do anything to achieve this.Nicole could in no way grasp how she had done something wrong to get James to the point that he would do something like this. What she was sure about, however, was the thought that she was not going to wait another week till court day to find it all out. Nicole was determined to come into that court meeting as prepared as possible…

    Suspicions of lying
    Up until now, all of James’ friends had told her that they had no idea of James’ whereabouts this past week. Now that Nicole finally knew what was going on and why her soon to be ex had disappeared, she expected that they had not been telling her the whole truth.

    Nicole got her list again with all the phone numbers of James’ friends. No time to waste, she thought, so she started calling all the numbers written on this piece of paper. When she finished, Nicole realized that she definitely had been getting some mixed answers. Some of the people still said nothing, while others sort of admitted that they were lying. There was one person with a very surprising answer… The answer had stunned Nicole.

    This person that before had stated to know nothing of the events that had been going on, told Nicole that she was probably better off asking some of her own friends for answers. Nicole’s friends were accused of knowing just as much as James’ friends did, and perhaps even more. Nicole was stunned by this.

    The conversation raised a lot of questions. Why would any of her friends know anything about her pending divorce while she herself only knew for a couple of hours yet?

    Did James tell someone about the divorce himself, and if so, who could that be?Regardless of any doubts she had, Nicole was willing to call every single one of her friends for answers.Making the callsShe picked up the phone and started calling Jennifer, one of her friends to whom James is also very close to. Jennifer and James saw each other from time to time, even if Nicole wasn’t there with them. Jennifer was also the friend who canceled the trip last minute.

    They both know that something wrong was happening but neither of them wanted to give the other an advantage.Nicole panicked and explained that she was looking for James. She hadn’t seen or spoken to him in a while and she needs answers from him. Jennifer told her that she didn’t know where he was. She promised to keep an eye out. It was as if Jennifer was ready to back Nicole up, but there were speculations that it wasn’t the case.

    After Nicole hung up, she went through the list of friends to call. She seemed to be nearing the end of the list and everyone she spoke to had no idea where James might be. There may have been more people involved but no one was certain about it. Until she got Patricia on the phone, who told her something revealing.Patricia told Nicole she didn’t know where James was at this moment but she assured Nicole that Jennifer could tell her more.

    To make things even stranger, Patricia revealed that Jennifer was helping James to hide from her.

    Nicole’s mouth fell open and she didn’t know what to say for a moment. She’d just had Jennifer on the phone!

    Furious

    Nicole decided to act immediately and to call Jennifer right back. How could she do this behind her back?

    Nicole demanded an explanation. But of course, Jennifer didn’t answer anymore. Nicole was boiling with anger and didn’t know what to do for a while. It was as if she was betrayed and she had no control over the situation.

    Nicole was bursting with questions. Why would Jennifer lie to her? Why is she helping James hide from her? How long has this been going on? In all anger, she decided to do something that in hindsight she probably shouldn’t have done, there may have been something she could have done differently…

    Jumping into her car

    Nicole didn’t hesitate for a second and decided to drive to Jennifer’s house. While wiping a few tears, she grabbed her coat and keys and got into her car. The moment she drove into Jennifer’s street, she saw her driving away. She started following her and ended up at a motel. There was more to what she suspected than met the eye.

    The first thing she saw after Jennifer got out was that she walked straight to a room and knocked on the door. Where she already saw it coming, her suspicions were confirmed: James opened the door. The betrayal she felt at the scene.

    She was very disappointed in both people, James and Jennifer, so she decided to come up with a plan.

    Collecting evidence

    Since the court trial starts in a few days, Nicole tried to follow the couple as much as possible so that she could bring hard evidence against James in court. In this way, she was able to substantiate what she saw and strengthen her position. She wanted to have the upper hand therefore taking that extra step was necessary.

    She discovered that they did everything together. They spent as much time together as they could. From grocery shopping to going to the cinema.Nicole realised James and Jennifer had a life together.But why didn’t they tell her anything? Nicole would have rather preferred she knew it beforehand rather than being lied to.She however would soon find out.

    Court Day

    The day of the trial has finally arrived. Nicole couldn’t wait to finally put this hell behind her and she hoped for a positive outcome. She pulled out her best clothes from her closet and began to mentally prepare.

    She went through all the arguments again, and all of a sudden a car honked. It was about to go down, and Nicole was at an advantage.

    It was her lawyer who suddenly showed up at her door! He decided to pick her up so that they could go through everything while driving. Nicole got more and more confident on her way to the courthouse. They had a big surprise for James which he probably wasn’t expecting. They knew something fishy was happening and they were about to reveal it.

    Arriving the court, Nicole wasn’t nervous at all until she climbed the stairs of the colossal building. It was all very close now. It would also be the first time she’d come face to face with James in a long time.

    At the entrance, his lawyer was waiting and wished them well. It was as if they had something up their sleeves and they were prepared for what was going to happen.

    The trial

    The trial had been going on for hours when it was finally Nicole’s turn to speak. She looked at all the people in the room, and to her great surprise saw Jennifer also sitting in the back of the room.

    How dare she?!

    There may have been something beyond the norm and how she was able to act in such a manner. She took a big breath and started talking…

    New evidence

    She told all the ins and outs of her relationship with James from her point of view. After she had said everything, she looked at her lawyer. He nodded approvingly. It was about time to release the news and she was thrilled to do so. That’s when he got up and said, “Just to add to this, we have additional evidence.”

    Her lawyer handed the folder to Nicole, who opened it. There were a number of photos in it, which showed that James and Jennifer spent a lot of time together. They both knew that they were married yet James took advantage of the vacation and acted this way. James and his lawyer were flabbergasted. How did they find out?

    Collecting evidence

    Nicole revealed that she had been told by several friends that Jennifer knew more, but did not want to tell. She also saw the two walking hand in hand ‘accidentally’ from a distance. From that moment on, she started collecting evidence to show that she didn’t do anything wrong. They were being watched without them even knowing.

    James and his lawyer tried everything to prove Nicole was wrong, but the burden of proof was too harsh. With every word they said, they only got into more trouble. All he could do was sulk in the news he has just heard and he had no way to escape it. It was very clear they were lying. From that moment, the mood turned…

    Apologizing

    James came to his senses and decided to offer his sincere apologies to Nicole. She started laughing and replied: “First you lied to me, then to the jury and now I have to believe you’re sorry?”

    James didn’t know what to answer. No apology would be enough to suffice the betrayal that he did.

    It didn’t take long for the judge to rule and find Nicole in her favor. She won the trial and James had to pay for the emotional damage he had done to her. He deserved the sentence and Nicole deserved better treatment from her ex-husband and best friend.

    On her way out, she saw Jennifer trying to run away as fast as possible.

    Yelling her name

    In all the adrenaline that was still inside her, Nicole didn’t hesitate for a moment and shouted out Jennifer’s name. Jennifer seemed to freeze.

    Nicole walked toward her and she asked why she didn’t tell her anything in the first place. How could she? They’ve been good friends for so long.

    Jennifer admitted she was too scared to tell her.

    She thought Nicole would have a tantrum or that James would freak out. She said she and James were just growing closer and she couldn’t help it.

    Nicole saw in her eyes that she was telling the truth. Nicole went home and on her way back a feeling emerged. She hasn’t felt this way in ages. She was glad that all the fuss was finally over and she was able to start a new life just for herself. Even though she will never forget James’ pasty complexion when he was forced to admit his affair with Jennifer.

    His face was so blanched it was as though he had doused it in flour. Nicole had never felt so disappointed, diminished and humiliated. James said he was sorry and that he had had an affair because he was unhappy and confused, that he didn’t want to hurt Nicole’s feelings and that he didn’t know how to communicate. He had felt overwhelmed by the responsibilities that came with being married and staying with one partner for a long time. He had realised he was more selfish than he’d imagined.

    Nicole told herself she never would have had the nerve to lead a double life like James did, to constantly lie to the person who loved him most. People are supposed to be born with a conscience. There is right and wrong; there is no in-between.Dear wife,I’m writing you this letter to tell you that I’m leaving you forever.     After all of this, I still loved you & felt we could work it out. So when I hit the lotto for 10 million dollars, I quit my job & bought us 2 tickets to Jamaica. But when I got home you were gone. Everything happens for a reason, I guess.
