Buganda Road Court Upholds Freedom of Speech in the Case of Motiv Kasagga

May 11, 2023

In a significant legal victory, the Buganda Road Court has dismissed computer misuse charges imposed on prominent National Unity Platform (NUP) party blogger, Bashir Kasagga, better known as Motiv Kasagga. The dismissal comes after a tumultuous period that saw Kasagga allegedly abducted and held in what he described as a safe house, reportedly by officers from the Chieftaincy of Military Intelligence (CMI).

Kasagga took to social media platform Twitter to confirm the dismissal of the charges, expressing his gratitude to his legal team, his party NUP, and its President, Bobi Wine, for their unwavering support throughout the ordeal. The blogger also emphasized the importance of speaking truth to power, stating that freedom is achieved by those who fearlessly advocate for a better Uganda.

“I’m thankful to my legal team led by Counsel Shamim Malende and Counsel Jkee Mwanje, my party NUP, and President Bobi Wine. Freedom indeed comes to those who speak truth to power. It’s only through speaking that we shall be heard,” tweeted Kasagga.

Despite facing threats and intimidation, Kasagga urged fellow activists and Ugandans to remain resolute in their pursuit of a better future. His case serves as a reminder that individuals should not back down when confronted with adversity in the fight for justice and freedom.

In light of the dismissal, Kasagga’s focus has now shifted to reclaiming his confiscated communication gadgets. He plans to visit the offices of the Criminal Investigations Department (CID) in Kibuli, Kampala, where his devices were reportedly taken during the security investigation into his case. In a firm message to the CID, Kasagga warned, “Prepare them in advance coz I’m coming for them.”

Motiv Kasagga’s journey from abduction to acquittal has captured the attention of many, shining a spotlight on the challenges faced by activists and bloggers in Uganda. His unwavering determination to hold those in power accountable serves as an inspiration to all those fighting for justice and freedom of expression.

As the case concludes, the eyes of the nation remain fixed on the ongoing struggle for human rights and civil liberties. Motiv Kasagga’s story has become a symbol of resilience and a testament to the power of individuals united in their pursuit of truth.
