ULS President Summoned for Allegedly Insulting DPP

The Buganda Road Chief Magistrate’s Court in Kampala has summoned Uganda Law Society (ULS) president, Mr. Isaac Ssemakadde, to appear in court on January 29 for allegedly insulting the Director of Public Prosecutions (DPP), Jane Frances Abodo.

Chief Magistrate Ronald Kayizzi ordered Mr. Ssemakadde to appear in court after finding sufficient grounds for the charge of indecent assault. The magistrate stated, “Referring to a woman by her private body parts is an insult to her modesty. Calling a woman ‘v***na from Karamoja… a pumpkin… dead wood… a dimwit’ at a public gathering, especially when media is present, is clearly intended to insult her modesty.”

The court issued summons against Mr. Ssemakadde to defend himself, following a letter from the Local Council Chairperson confirming the utterances were made on November 18, 2024. The Ward Administrator also confirmed the incident in a letter dated January 15, 2025.

Mr. Kayizzi noted that the person in the video evidence was identified as Isaac Kimaze Ssemakadde, president of ULS, and his advocates did not dispute this when they appeared in court on December 4, 2024. Despite Mr. Ssemakadde’s lawyers arguing that the case should not proceed since Justice Abodo did not complain, the magistrate ruled that any person with reasonable cause can make a complaint, regardless of being the victim.

The magistrate concluded that a prima facie case had been established for insulting the modesty of a woman under Section 115 (3) of the Penal Code Act. Mr. Ssemakadde was summoned to appear in court on January 29, 2025, to answer the charge.

This decision follows a private prosecution initiated by two lawyers, Mr. Tonny Tumukunde and Mr. Joshua Byamazima, against Mr. Ssemakadde for allegedly making the remarks during a symposium on November 18, 2024. The court also dismissed Mr. Ssemakadde’s application to dismiss the complaint, ruling that his court has jurisdiction to hear and determine the case.
